Android Terms of Service

1. Introduction

These Terms of Service ("Terms", "Terms of Service") govern your use of our Android mobile applications operated by Bivex Teknoloji A.S. ("Bivex", "Company", "we", "our", "us").

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our applications. Please read it here: Android Privacy Policy.

Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

2. Description of Services

Bivex provides AI-powered mobile applications for Android that offer various features including but not limited to:

AI-powered photo and video editing
Beauty filters and enhancement tools
Face swapping technology
Video effects and filters
Image processing and manipulation tools

3. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you must have parental or guardian consent to use our Services. By using our Services, you represent and warrant that you meet these age requirements.

4. Subscriptions

Some parts of Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a weekly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

Subscription Terms

Our Service includes both free features and premium features available via an auto-renewable subscription ("Subscription"). By purchasing a Subscription, you agree to the following:

Billing and Renewal

Subscriptions automatically renew weekly or annually, depending on the subscription, unless you cancel at least 24 hours before the end of the current billing cycle.
Payment is charged to your Google Play account at confirmation of purchase.
Your account is charged for renewal within 24 hours prior to the end of the current subscription period.
Any unused portion of a free trial (if offered) is forfeited upon purchase of a Subscription.

Cancellation

You can manage or cancel your Subscription anytime through your Google Play account settings.
Cancellation takes effect at the end of the current billing cycle, and you will retain access to premium features until that time.
We do not offer refunds or credits for any amounts already billed or paid.

Pricing Changes

We reserve the right to change our Subscription pricing at any time.
Any price change will apply to your next subscription period, or 30 days after notice, whichever is later.

No Refund Policy

All payments made after any free trial period are final and non-refundable.
By continuing your Subscription, you acknowledge and agree that you will not receive a refund or credit once billing has occurred.

5. Content and User Responsibilities

Our Service allows you to upload, process, and edit photos, videos, and other content ("Content"). You are responsible for Content that you use with our Service, including its legality, reliability, and appropriateness.

You retain any and all of your rights to any Content you submit or process through our Service. We take no responsibility and assume no liability for Content you process through Service. However, by using our Service you grant us the right and license to process your Content solely for the purpose of providing our AI-powered features.

6. Prohibited Uses

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

In any way that violates any applicable national or international law or regulation.
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
To create deepfakes or misleading content without proper disclosure.
To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.
In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful.
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Service.

7. Age Restrictions

Service is intended only for access and use by individuals at least thirteen (13) years old. By accessing or using any of our Services, you warrant and represent that you are at least thirteen (13) years of age. If you are not at least thirteen (13) years old, you are prohibited from both the access and usage of Service.

8. Intellectual Property

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Bivex and its licensors. Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Bivex.

9. AI Technology Disclaimers

Our AI technology is provided "as is" and you acknowledge that:

AI results may vary and are not guaranteed to be perfect
Processing quality depends on input material quality
Some features require internet connectivity
Processing times may vary based on device capabilities
We continuously improve our AI models, which may affect results

10. Limitation of Liability

EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD US AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIVEX SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES.

11. Termination

We may terminate or suspend your access to Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Turkey without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of Turkish courts.

13. Changes to Terms

We may amend Terms at any time by posting the amended terms within our applications. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
